Welcome to Cappin'. These Terms of Service govern your use of cappinshop.com and any purchase you make from us. By using this site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

We're operated by Cappin', 8601 Lincoln Blvd, Ste 180 #282, Los Angeles, CA 90045.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to purchase from this site. By ordering, you confirm that the information you give us is accurate and that you're authorized to use the payment method you provide.

2. Products, pricing and availability

All products are subject to availability. We may change prices, discontinue products, or limit quantities at any time without notice.

We work hard to display our products accurately, but we can't guarantee that your screen shows colors exactly as they appear in person. Satin sheen and fabric prints in particular vary under different lighting and on different displays.

If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and refund you in full, even after the order is confirmed.

3. Orders and cancellation

Your order is an offer to buy. We may accept or decline any order for any lawful reason, including suspected fraud, reseller activity, or errors in pricing or product information.

Because we process orders within 48 hours, cancellation requests must reach us before the order ships. Email info@cappinshop.com as soon as possible. Once shipped, our Refund Policy applies.

4. Payment

We accept the payment methods displayed at checkout. You authorize us to charge your payment method for the full order total including shipping and applicable taxes. All prices are in US dollars.

5. Shipping and returns

Shipping is governed by our Shipping Policy. Returns and exchanges are governed by our Refund Policy. Both are incorporated into these terms.

6. Intellectual property

All content on this site — the Cappin' name and logo, CAPPSPIRACY, product designs, photography, copy, and graphics — is our property or used under license, and is protected by US and international intellectual property law.

You may not reproduce, distribute, or create derivative works from our content, or use our trademarks, without written permission. You may share our content on social media with attribution.

7. Reviews and customer content

If you submit a review, photo, comment, or any other content to us or about us, you grant Cappin' a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with our business, including in marketing.

You confirm the content is your own, that you have the right to share it, and that it doesn't violate anyone else's rights. We may edit for length or clarity, and we may remove content that is unlawful, abusive, or misleading. We do not pay for reviews and we do not condition any incentive on a review being positive.

8. Acceptable use

You agree not to use this site for any unlawful purpose, to attempt unauthorized access to our systems, to interfere with the site's operation, to scrape or harvest data, or to resell our products without written authorization.

9. Disclaimer of warranties

Except where prohibited by law and except as expressly stated by us, this site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.

We don't warrant that the site will be uninterrupted, secure, or error-free, or that any product will meet your expectations.

Some states do not allow the exclusion of implied warranties, so some of this may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Cappin' and its owners, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of this site or any product purchased from us.

Where liability cannot be excluded, our total liability to you is limited to the amount you actually paid for the product giving rise to the claim.

Nothing in these terms excludes liability for fraud, or for any liability that cannot lawfully be limited.

11. Product disclaimer

Our products are subject to the Legal Notice, which you should read before purchasing. In short: our hats are apparel, not medical or therapeutic devices.

12. Indemnification

You agree to indemnify and hold harmless Cappin' from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.

13. Changes to these terms

We may update these terms at any time. The current version is always posted here with its "last updated" date. Continued use of the site after changes means you accept them.

14. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Los Angeles County, California.
